Food Allergy & Intolerance Resources has a policy of honesty and integrity which it applies to all its business transactions.

This page is intended to give clear information on your Rights, as well as our Terms & Conditions of business. If you have any queries on these terms please contact us for a full explanation. You may also care to read our Privacy Policy.

Guarantee

We will honour without question all rights conferred on you by the Distance Selling Regulations and any other applicable UK legislation. These may include the right to a refund.

In the unlikely event that an item is faulty the purchaser must contact us for a Returned Merchandise Authorisation (RMA) Code and return the products to us by an agreed method for evaluation, at their own expense. However, any costs incurred in doing so will be fully refunded if the product is found to be genuinely faulty. This warranty does not cover failure of any product due to misuse, abuse, unauthorised modification or repair, accidental damage, wear and tear, or any cause other than defective materials. Please take extra care to read the wash care instructions on each product as we will not accept or offer a refund or exchange if they have been damaged in the wash. 

You are responsible for any returned goods until they reach us. A proof of postage certificate must be obtained when returning goods. Proof of Posting Certificates are available free of charge from the post office. All products manufactured by another manufacturer and sold by us are covered by the Guarantee or Warranty provided by that manufacturer. However, we will endeavour to assist you with any claim under the manufacturer’s warranty and, at our discretion, may replace, at our own expense any genuinely faulty products. If you ask us to replace the product from our stocks and we agree, you agree to provide us with any information that we may reasonably request that may be needed in order for us to obtain redress from the manufacturer.  

These warranties are in addition to, and do not affect, your statutory rights.

Distance Selling:

The Consumer Protection (Distance Selling) Regulations 2000.

This section sets out those items required by the Distance Selling Regulations - Consumer Protection (Distance Selling) Regulations 2000.

Identity:

The supplier of any goods purchased is: Food Allergy & Intolerance Resources. P.O. Box 836, Taunton, TA4 3WS United Kingdom.

Description of Goods:

The goods sold pursuant to these Regulations comprise items selected from those described on our Website or any other goods made to special order or offered via any other remote method such as email or special offer. While every effort has been made to portray items accurately, slight variations may occur. All measurements quoted are approximate and the reproduction of colours is as accurate as photographic and publishing processes will allow. Please note there may be variations in colours dependant on the calibration and settings of individual screens and browsers.

Price:

The price of goods purchased via the Website shall be the price advertised on our website,  price list, mail order brochure, or provided by us in the form of a Quotation at the time of purchase together with Value Added Tax and any other relevant tax thereon (if applicable) at the rates prevailing from time to time.

Quotations:

For special orders, except where an obvious error has been made by us, all Quotations are unconditionally valid for a period of 30 days. After 30 days we will respect our original quotation providing the cost of providing the goods to the customer has not risen by more than 10%. After 30 days a new Quotation must be obtained.

Delivery Costs:

U.K Delivery:

Goods are delivered directly to your specified delivery address. The delivery charge will reflect the cost of packaging, weight of the items and despatch, by Royal Mail or Courier Company.

U.S.A, Canada, & Europe:

As with U.K delivery the cost of delivery is calculated on the weight of your basket. Baskets weighing over 2kg may incur a surcharge for the use of an alternative courier, however you will be notified should this be the case and you will be given the opportunity to cancel your order. It is very unusual for a shopping basket to weigh in excess of 2kg. Your order will be sent via Royal Mail International Signed For Service and you will be required to sign for your parcel upon delivery. You will have the opportunity with some items to opt out of "signed for" and your delivery charge will be discounted accordingly as this is a premium service for which we are charged. However if you chose to opt out and recieve your goods via the standard Airmail Service we can not and will not be held responsible for items lost in the post. This forms part of our Terms & Conditions.

Payment:

Payment for any goods purchased pursuant to these terms must be made by Credit/Debit card, or Cheque. Payment must be made at the time of placing the order and prior to delivery. Credit Card & Debit Card payments are facilitated by World Pay.

Unavailability:

All items are subject to availability. In the event that the goods are temporarily unavailable or out of stock, we will not substitute items unless you specifically ask us to do so. We recognise that the unsolicited substitution of goods is both annoying, and unnecessary. 

Cancellation:

In accordance with the Regulations, individual consumers who purchase from us using a 'distance' method such as the Internet, Email, Mail Order or Telephone have a right to a 'cooling off period' during which they can cancel their order for any reason. Consumers may cancel applicable orders at any time within seven working days starting from the day after their receipt of goods or services. This right does not apply to business purchasers, special orders (please see special orders section for more details), personalised items, nor to any customers who purchase goods whilst visiting our premises, or during exhibitions.

·        Cancellation Requirements for standard products:

All standard products sold by or made by us may be returned un-opened in their original packaging and condition for any reason, and a full refund will be provided. For clothing the item must still have the security label attached in the original manner. To take advantage of this right you must notify us within a period of 7 working days from receipt of your order, and return the goods to us at your own expense within a reasonable time from that notification. We will provide you with a Returned Merchandise Authorisation (RMA) number, which must be shown clearly on the packaging and any correspondence. We reserve the right to charge a nominal 20% re-stocking charge.

·        Special Order Products:

The right to cancel does not apply to personalised items or special order products. 

·        Special Order Products:

Special orders are those specially manufactured to the specification of the customer. This may relate to large volume quantities, or bespoke products or personalised items. All Special Order products (i.e. items that we do not normally sell, large volume, or items that are not shown in our catalogues and promotional literature or on our website, but which a customer asks us to obtain specially for them) are ordered individually and specifically at the customer's request and to their specification and so are exempt from the Cancellation provisions of the Regulations. These orders cannot be cancelled, and no refund is available. In circumstances of genuine hardship we may, at our sole discretion, agree to waive part or all of its rights and provide a partial or full refund to customers affected, even though they are not entitled to such a refund by Law. Each case will be reviewed individually.

None of the above affects your Statutory Rights in any way.

Opening Hours:

As a small business and a growing Internet based operation it is not possible for us to ensure that our telephones and computers are always manned. Whenever it is possible you will be answered by a Human Being when you contact us, whether by telephone or email. You can usually be confident of reaching a real person between 10.00am and 5:30 p.m. Monday to Friday.  If it is not possible for someone to answer you immediately we provide an answering service. Call charges: Calls to our main office telephone number are charged at the following:

BT landlines: up to a maximum of 10p per min at all times.

Mobiles & Other networks: please contact your network provider.

Performance:

We set ourselves the following targets for our Standards of Service:

·         We expect to answer our phones within 6 rings, whether by a person or automatically.

·         If you do get the answer-phone message it means that we are experiencing very heavy call levels. However, if you leave your name and number someone will get back to you as soon as possible.

·         We expect to give each customer as much time as they need to ensure that they obtain the information or products that they need.

·         We expect to reply to Answer-phone messages in the order they are received within 24 hours of receiving them. However, it must be understood that we may not actually receive them immediately they are left - it could be the next day if your message is left late at night, for example.

·         We expect to reply to an email message within 24 hours of receipt. Again bear in mind that we may not receive your email immediately due to many factors including delays on the internet itself or problems with your internet service provider.

 IF YOU HAVE NOT HEARD FROM US WITHIN 24hrs CHECK YOUR SPAM FOLDER or JUNK MAIL.

   ·         We expect to reply to a letter within five days of receipt.

·         We expect to dispatch your goods in good time. Our estimated delivery time is 7 days, personalised items may take up to 14 days from receipt of your order. If due to external influences, for example a postal strike or other external influence, there is going to be a delay in the receipt of your goods we will inform you at the earliest opportunity.

In addition to the terms shown as part of our Distance Selling Regulations Statement the following terms apply to the use of this site and the provision of our Products and Services:

·         Any information found on this web site is intended for guidance only. The web site and the products described in it are subject to change without notice.

·         We will not be liable for damage to, or viruses that may affect your computer equipment, software, data or other property as a result of your access to, use of or browsing of this Website or your downloading of any materials, data, text or images.

·         We do not guarantee that this web site will be compatible with all hardware and software that may be used by visitors to the site.

·         The copyright in the design, images, and content of this site is and remains the property of the creator. All rights are reserved. Some images or information may have been provided by third parties, and may be subject to their copyright. In each case the individual images or pieces of information are used with permission and the copyright of the owner is acknowledged. Infringement of Copyright, Design Registration and Patent will be pursued in all cases.

·         Payment for products must be made at the time of placing an order, unless an alternative arrangement has been approved in advance by an authorised representative.

·         We will do our best to deliver the goods as soon as possible after your order has been accepted. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In the event that such a delay becomes likely, we will inform you as soon as possible.

·         Our terms take precedence over any conflicting terms of individuals or organisations. Purchasing our Products and Services. We cannot accept any orders where the purchaser requires their own terms to take precedence.

·         No contract exists between us for the sale of any goods until we have received and accepted your order and payment in full in cleared funds. Once we have accepted your order and payment there is a binding legal contract between us. By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

·         Invoices and confirmations are automatically sent via Email to the address given when you place your order. We do not normally post invoices or other documents.  

·         We may change these terms of sale without notice in relation to future sales. However, our current terms will always be available to view on this site and a copy will be made available via email on request.

Complaints Policy:

We try very hard to ensure that you will have no cause for complaint about the products and services supplied by us. However, we are only human and it is possible that at some time a mistake may be made. In the unlikely event of this happening it is our stated intention to address the problem directly, and to learn from any problem that may arise in order to reduce the chances of any future difficulty from a similar cause. We undertake to:

·         Deal with any problem that may arise quickly, efficiently and sympathetically.

·         Always treat our customers with respect and courtesy.

·         Put right as a matter of course anything that we may do wrong - our customers should expect that rather than hope for it!

·         Give all our staff the authority to deal with simple complaints on the spot without needing to refer to senior management.

·         Always allow customers to access the highest level of staff if they are dissatisfied with a decision of a less senior staff member.

·         Learn from any complaint we may receive so that any avoidable problem is not repeated.

If we cancel an order, it will be without charge to you.

Access to Food Allergy & Intolerance Resources:

We will do our utmost toensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

Guest Book Comments:

Users of this website may submit suggestions, ideas, comments, or questions onto the  guest book as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."
